The drug has been under scrutiny lately for everything from elevated <strong>cancer risk</strong> and <strong>serious side effects</strong> to ineffectiveness. This week, the Food and Drug Administration (FDA) issued a <strong>safety announcement</strong> about <strong>simvastatin</strong>, one of the two active ingredients found in the medication, and an increased risk of a potentially life-threatening <strong>muscle injury</strong>.<span id="more-473"></span></p>
<p><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a> combines simvastatin (sold as in individual ingredient under the brand name <strong>Zocor</strong>) and <strong>ezetimibe</strong> (also known as <strong><a href="http://www.vytorin-lawyer.com/tag/zetia/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Zetia">Zetia</a></strong>) to reduce the production of “bad” <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a>. An FDA review of data from clinical studies, adverse event reports, and prescription use of simvastatin indicated patients who took doses of 80 mg or more of simvastatin were at greater risk for developing a muscle injury known as myopathy. <strong>Myopathy</strong>, which causes pain, tenderness or weakness, is a known side effect of all statin drugs. Myopathy can lead to <strong>rhabdomyolysis</strong>, a more serious condition that can lead to kidney failure, which can be fatal.</p>
<p>Much of the data reviewed by the FDA came from the Study of the Effectiveness of Additional Reductions in <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">Cholesterol</a> and Homocysteine (SEARCH), a clinical trial aimed to better understand the relationship between high-dose simvastatin use and muscle injury.</p>
<p><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a> also carries a risk of <strong>liver damage</strong> and liver problems such as <strong>hepatitis</strong>, <strong>cirrhosis</strong> and even <strong>liver failure</strong>. A February 2008 study also found that <a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a> was no more effective than simvastatin alone in lowering <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a>, and that patients taking <a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a> actually had more plaque buildup than patients taking simvastatin alone.</p>

			<content:encoded><![CDATA[<p><img class="alignleft size-thumbnail wp-image-470" title="fda-logo" src="http://www.vytorin-lawyer.com/media/2009/12/fda-logo-100x100.jpg" alt="fda logo 100x100" width="100" height="100" />The <strong>U.S. Food and Drug Administration</strong> <a href="http://www.fda.gov/Drugs/DrugSafety/PostmarketDrugSafetyInformationforPatientsandProviders/DrugSafetyInformationforHeathcareProfessionals/ucm194964.htm">announced today</a> that it found no clear link between <strong><a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a>’s </strong>blockbuster <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a> drug <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" title="" rel="external">Vytorin</a></strong> and increased <strong>risk of cancer</strong>, but it could not rule out the possibility that such a link exists. The agency reviewed data from three <a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a> trials, including the controversial <strong>SEAS trial</strong> results, which <a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a> had withheld from the public for 18 months as it aggressively marketed the drug.<span id="more-466"></span></p>
<p>The SEAS study sought to test <a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a>’s effectiveness as an alternative to surgery in reducing arterial clogging caused by high <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a>. The results, which were announced in a July 2008 press conference, did not favor the drug. Not only did researchers find that <a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a> worked no better than cheaper, generic statins, they also discovered that patients taking <a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a> experienced 50 percent more <strong>new cancer cases</strong> and <strong>cancer deaths</strong> than the subjects who took placebos.</p>
<p><a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a> and some of the researchers connected to the SEAS study dismissed the results as a “fluke,” while many physicians and medical researchers not connected to the drug company remained skeptical and cautioned consumers to stick with <strong>traditional statins</strong> to control <strong><a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a></strong> levels. For instance, <a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a>&#8217;s Zocor, taken alone, was shown to be more effective than <a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a> and cost about one-third as much because it had become available as a <strong>generic drug</strong>.</p>
<p>That research promoted many municipalities that had included <a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a> in their health plans to file <strong>lawsuits</strong> against <a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a>, essentially asking for their money back. <a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a> and its sister drug <strong><a href="http://www.vytorin-lawyer.com/tag/zetia/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Zetia">Zetia</a></strong>, made by <strong><a href="http://www.vytorin-lawyer.com/tag/schering-plough/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Schering-Plough">Schering-Plough</a></strong>, brought in sales of more than $5 billion at their peak. The sales have fallen but continue to earn $4 billion annually.</p>
<p><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a> is a hybrid drug which combines <a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a>’s Zocor with <a href="http://www.vytorin-lawyer.com/tag/schering-plough/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Schering-Plough">Schering-Plough</a>’s <a href="http://www.vytorin-lawyer.com/tag/zetia/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Zetia">Zetia</a> to combat both dietary and hereditary <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a>. The FDA said that ample evidence exists showing Zocor to be safe, but <strong>insufficient evidence</strong> exists on <a href="http://www.vytorin-lawyer.com/tag/zetia/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Zetia">Zetia</a> to “rule out a cancer risk at this time.”</p>
<p>Two additional <a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a> studies known by the acronyms SHARP and IMPROVE-IT are ongoing and scheduled to end in 2010 and 2012.</p>

The results of the trial, which the <em>New England Journal of Medicine</em> featured in an article and two editorials, were presented Sunday at an <a href="http://www.americanheart.org/presenter.jhtml?identifier=1200000">American Heart Association</a> meeting and showed that in a direct comparison, niacin worked significantly better than <a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a> and <strong><a href="http://www.vytorin-lawyer.com/tag/zetia/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Zetia">Zetia</a></strong> in reducing <strong>arterial blockages</strong>. According to a report in <a href="http://www.npr.org/">NPR</a>, &#8220;This study is the third to question whether <a href="http://www.forbes.com/2009/11/15/zetia-merck-vytorin-business-health-care-pharmaceuticals.html">ezetimibe drugs do what they&#8217;re supposed to</a>.&#8221;</p>
<p><span id="more-458"></span></p>
<p>If lowering <strong>LDL</strong> or “bad” <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a> is the doctor&#8217;s sole intention when prescribing <a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a> to patients, then the drug does a great job. However, as previous studies have shown, lower levels of LDL <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a> don’t automatically translate to cleaner arteries and lower incidences of <strong>cardiac arrest</strong>. While <a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a> worked better than statins combined with time-release Niacin to lower LDL <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a> in 200 patients, its performance was inferior in reducing artery clogging deposits.</p>
<p>In fact, five of <a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a> group patients suffered <strong>five fatal heart attacks</strong> – a rate significantly and statistically higher than the niacin group, in which just one fatal heart attack occurred. The key to understanding the difference may lie in “good” <strong>HDL</strong> <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a>, which pulls LDL buildup from artery walls. While niacin is known to raise HDL levels, <a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a> actually lowers levels of good <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a>.</p>

The company says that lowering LDL <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a> is the “well established” and “primary target” of therapy.</p>
<p>&#8220;<a href="http://www.vytorin-lawyer.com/tag/zetia/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Zetia">Zetia</a> and <a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a>, when used as a supplement to a healthy diet, are effective in reducing LDL <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a>,&#8221; said Peter S. Kim, President of <a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a> Research Laboratories, in a statement.</p>

<p>The Enhance study revealed that the pairing of <a href="http://www.vytorin-lawyer.com/tag/schering-plough/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Schering-Plough">Schering-Plough</a>&#8217;s <strong><a title="Posts tagged with Zetia" rel="tag" href="http://www.vytorin-lawyer.com/tag/zetia/">Zetia</a></strong> and <a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a>&#8217;s <strong>Zocor</strong>, which constitutes <a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a>,<strong> </strong>to be no more effective and possibly even less effective than <strong>Zocor</strong> alone or other <a href="http://www.vytorin-lawyer.com/news/2008/04/01/doctors-recommend-staying-with-statins/">much cheaper, generic statins</a> in treating arterial plaque.</p>
<p>But more than the disappointing results, there was the delay in making this information public. Results of the Enhance trial were completed in April 2006 but were not released until January 2008, after mounting pressure and suspicion over the delay.</p>
<p>Many plaintiffs, including <a href="http://www.vytorin-lawyer.com/news/2008/10/20/new-haven-wants-to-recover-vytorin-money/">a number of municipalities</a>, sued <a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a> and <a href="http://www.vytorin-lawyer.com/tag/schering-plough/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Schering-Plough">Schering-Plough</a> upon discovering that the drug makers knew the results of the <strong>Enhance trial</strong> but withheld them from the public for up to 2 years. The trial revealed <a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a> to be <strong>no more effective than cheaper generic statins</strong> in controlling <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a>.</p>
<p>Nevertheless, the drug makers forged ahead with aggressive marketing campaigns for <a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a>, earning billions while allegedly knowing about the drug’s shortcomings.</p>
<p>Last month, <a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a> and Schering agreed to settle with attorneys general from 35 states who claimed the drug makers improperly marketed <a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a> and <a href="http://www.vytorin-lawyer.com/tag/zetia/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Zetia">Zetia</a>. <a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a> agreed to pay the states $5.4 million for costs accrued in investigating the potential <strong>violations of consumer-protection laws</strong>.</p>
<p>The settlement announced this week resolves all of the lawsuits seeking class-action status that were filed in New Jersey federal courts by consumers who bought and used <a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a> or <a href="http://www.vytorin-lawyer.com/tag/zetia/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Zetia">Zetia</a>. Many of the complaints sought compensation for <strong><a href="http://www.southerninjurylawyer.com/personal-injury/" title="" rel="external">personal injury</a></strong> caused by the drugs. The SEAS trial uncovered a possible link between <a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a> and higher cancer risks.</p>
<p>Lawsuits against the companies over securities law violations are still pending, as is the <strong>U.S. Department of Justice’s</strong> investigation into whether the drug makers’ marketing tactics led to false claims being submitted to federal healthcare programs. Moreover, congressional committees continue to inquire about the companies’ handling of the Enhance trial.</p>

Dr. Kate Scannell, columnist for the <a href="http://www.contracostatimes.com/columns/ci_11426254?nclick_check=1">Contra Costa Times</a>, which serves the California Bay Area, listed the drug under the header &#8220;statin madness.&#8221;</p>
<p>Dr. Scannell said the drug made her list as a result of two studies that revealed <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a></strong>, which is a combination of simvastatin (Zocor) and ezetimibe (<a href="http://www.vytorin-lawyer.com/tag/zetia/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Zetia">Zetia</a>), <strong>did not reduce</strong> artery-clogging plaque buildup, although tests showed it reduced &#8220;bad&#8221; <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a> levels.<br />

However, she said <a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a>&#8217;s bad year wasn&#8217;t all bad for consumers, as research from the study revealed a fundamental benefit of <strong>statin drugs</strong> to people with normal cholesteral but high indicators of inflammation. She says the <a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a> failure also brought to light &#8220;the importance of knowing how new drugs actually affect the people who take them &#8211; not just their blood tests.&#8221;</p>

<p>Now Congress is investigating the promotion of <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a></strong> as lawsuits against its makers pile up in state and federal courts. But <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a></strong> isn’t the only heavily promoted new drug to cause problems, so some congressmen are planning to pull in the reins of direct-to-consumer (DTC) drug advertising.</p>
<p>Rep. Henry Waxman (D-Cal.) has renewed the call to give regulators the power to ban DTC advertising for new prescription drugs when their safety profiles aren’t fully known. The would-be legislation, which emerged in 2007 but ultimately failed to pass, is plowing ahead in the wake of some heavily promoted but beleaguered blockbuster drugs.</p>
<p>Like <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a></strong>, <strong><a href="http://www.chantix-legal.com/" title="" rel="external">Chantix</a></strong> and <strong><a href="http://www.beasleyallen.com/focus/Vioxx/" title="" rel="external">Vioxx</a></strong> were more or less indicted after tests and reports brought unknown risks to light, and each made billions in profit before negative news rained on their parade.</p>
<p>Rep. Waxman, who becomes chairman of the House of Representatives Energy and Commerce Committee when the new Congress convenes in January, has expressed his interest in revisiting the drug ad issue.</p>
<p>“It is these first few years of a drug&#8217;s life that drug companies often aggressively market their products and engage in direct-to-consumer advertising. This increases the number of consumers exposed to safety risks of new products long before those risks are truly understood,” Waxman said at a <a href="http://www.prescriptionproject.org/about/">Prescription Project Conference</a>.</p>
<p><strong><a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a>’s</strong> blockbuster anti-inflammatory drug Vioxx was taken by approximately 20 million people before its risk of cardiac events became known. <strong><a href="http://www.chantix-legal.com/" title="" rel="external">Chantix</a></strong> was taken by millions of people as well before researchers understood the risks the drug posed for depression, suicide, and other serious side effects. And, of course, <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a></strong>, which millions of people took before one test exposed it as a dud and another as a possible caner risk.</p>
<p>To help ease the dangers posed by new medicines, Congress sought last year to give the FDA the authority to ban the television advertising of new prescription drugs for as long as three years if it was deemed necessary to protect the public. The ban would not be a blanket ban on all new prescription drugs, but would be enacted on a case by case basis.</p>
<p>Exaggerated benefits and minimized perception of side effects are two pitfalls of DTC advertising for the general public. Excessive prescribing is another, but that seems to be the whole point, at least from the drug manufacturers’ point of view. Television ads for new prescriptions aren’t made with the public’s good in mind. They’re made to maximize profit. Advertising for profit is the American way, but when it amounts to messing with the health of millions, clearly some restraint is needed.</p>
<p>According to a <a href="http://www.reuters.com/article/rbssHealthcareNews/idUSN0850286920081208">report by Reuters</a>, drug makers claim that their ads are informative to the general public and that they have adopted voluntary guidelines that have them refrain from advertising for “an appropriate amount of time” so doctors can be informed of the new drugs first.</p>
<p>In the case of <strong><a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a>’s</strong> diabetes drug Januvia, however, little time was wasted between the drug’s approval and <strong><a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a>’s</strong> massive marketing efforts.</p>
<p>Another <a href="http://news.yahoo.com/s/nm/20081203/hl_nm/us_pharmaceuticals_marketing_2">report by Reuters</a> says that the &#8220;the product Web site was functional within 90 minutes of approval, and within eight days, <a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a> had reached 70 percent of target doctors and made first deliveries of [Januvia] to pharmacies. Within 14 days, discussions were completed with managed care organizations covering around 188 million patients or 73 percent of the insured U.S. population.&#8221;</p>
<p>The 2007 attempt failed after some lawmakers objected it would violate constitutional protections of free speech. Instead, Congress gave the FDA authority to fine companies for running false or misleading promotions.</p>

Nearly a year ago, <strong><a href="http://www.vytorin-lawyer.com/tag/schering-plough/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Schering-Plough">Schering-Plough</a></strong> promised to provide regular reports on the performance of its anti-<a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a> market. Their last update, which was filed with the Securities and Exchange Commission in mid November, indicates that <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a>’s</strong> plunge has actually leveled off.</p>
<p>Much speculation has been made about where <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a></strong> and <a href="http://www.vytorin-lawyer.com/tag/zetia/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Zetia">Zetia</a> (<a href="http://www.vytorin-lawyer.com/tag/zetia/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Zetia">Zetia</a> is a component of <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a></strong>, as well as a freestanding prescription drug) would bottom out. The total number of prescriptions written in October was 2,186,000, which represents a slight increase over September’s figure of 2,171,000.</p>
<p>Despite the slight gains, however, the chances of a future <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a></strong> / <a href="http://www.vytorin-lawyer.com/tag/zetia/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Zetia">Zetia</a> freefall still look good. In 2009, many <strong>Medicare</strong> Part D changes take effect, and many of the providers have kicked <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a></strong> down to Tier-3 status or worse in their formularies based on the clinical evidence that <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a></strong> is no more effective than cheaper, generic statins. Therefore, <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a></strong> will become a much more expensive option for patients. In today’s economy &#8212; and most likely even in tomorrow’s economy &#8212; a prescription that costs much more than generics yet performs on par with them or even worse than them, is not likely to be winner.</p>

			<content:encoded><![CDATA[<p>Many Americans assume that the <strong>Food and Drug Administration</strong> adequately tests new drugs for safety before they go on the market and become available to the general population. If your doctor prescribes a new drug to help you lower your <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a> or help you quit smoking, then that drug must be safe, right?</p>
<p>The answer is a surprising, and disconcerting, NO.<span id="more-405"></span></p>
<p>Trials for new prescription drugs that are vying for a place in the market focus on efficacy rather than safety. If pre-market clinical tests find a drug to be effective and that drug does not appear to be unsafe, then the <strong>FDA</strong> typically approves the drug and that drug enters the market. Many pre-market studies, however, simply are not large enough to allow researchers to gauge the safety of a new drug. A <strong>determination of safety</strong> is made usually after thousands of people have taken the drug. That is to say, the safety of a new drug is only fully known once it has been widely available to consumers.</p>
<p>Taking new prescription medicines makes the consumer an unwitting guinea pig of sorts. The hybrid anti-<a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a> drug <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" title="" rel="external">Vytorin</a></strong>, for instance, was prescribed to millions of people before the ENHANCE trial found it to be effective in lowering LDL <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a> levels but ineffective in preventing cardiac events, which is its ultimate purpose. Another trial named SEAS later suggested that <strong>Vtytorin</strong> increased the odds of developing and dying from cancer. <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a> </strong>continues to be sold while researchers continue probing its effectiveness and safety. The results from larger tests aren’t expected until 2012.</p>
<p>Currently, the <strong>rights of consumers</strong> who have been harmed by toxic prescription drugs and faulty medical devices are standing on unsteady ground. The issue of <strong>pre-emption</strong>, the legal notion that FDA approval of a drug trumps state laws concerning safety, efficacy, and proper labeling, is now before the <strong>United States Supreme Court</strong>. Diane Levine, a musician from Vermont, sued Wyeth earlier this month over inadequate labeling of the drug Phenergan, which caused her to lose part of her right arm. Wyeth’s defense argues that the company shouldn’t be held responsible by state laws because the drug met federal standards by gaining FDA approval.</p>
<p>If the Supreme Court rules that federal standards do supersede state laws, or if it throws the case out altogether, then many people may have <strong>no legal recourse</strong> should they ever fall victim to risky drugs and medical devices.</p>
<p>Keeping the issue of <strong>pre-emption</strong> in the public eye as the Supreme Court mulls the Levine case, a non-profit group called <a href="http://www.afj.org/">Alliance for Justice</a> has created a documentary about <strong>pre-emption</strong>. <p>If <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a></strong> ad campaigns and promotional media were based on a false or misleading premise, and the drug isn’t all its manufacturers publicized it to be (as the drug trials suggest), then government programs spent millions of dollars on reimbursement for a drug that is ineffective, possibly dangerous, and much more expensive than generic <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a> medications.</p>
<p>Additionally, 35 attorneys general are investigating to see if any state consumer protection laws were violated by the marketing.</p>
<p>Connecticut Attorney General Richard Blumenthal is one of the state attorneys investigating the matter. &#8220;We believe that there are very real and serious issues that may have affected consumer pocketbooks, if not their health, and we intend to pursue these issues vigorously,&#8221; he told the <em>Wall Street Journal</em>.</p>
<p><strong><a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a></strong> and <strong><a href="http://www.vytorin-lawyer.com/tag/schering-plough/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Schering-Plough">Schering-Plough</a></strong>, both New Jersey based corporations, said they were cooperating with the investigations and jointly responding to the inquiries.</p>
<p>Earlier this year, the House Energy and Commerce Committee launched an investigations into the safety of <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a></strong> and the ways in which the drug was marketed.</p>
<p>It is widely believed that <strong><a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a></strong> and <strong>Schering Plough</strong> concealed unfavorable trial results for up to two years in an effort to protect the drug’s stellar sales. Both companies deny the accusation that trial data were withheld.</p>
<p><strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a></strong> is already the subject of a number of lawsuits seeking class action status. Approximately 140 such suits have been filed across the country.</p>

			<content:encoded><![CDATA[<p><a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">Cholesterol</a>-fighting medicine may fail some people, as the controversial and embattled drug <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" title="" rel="external">Vytorin</a></strong> illustrates, but now medical technology provides a solution for those who just can&#8217;t lower their <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a> any other way: a <strong><a href="http://www.bbraunusa.com/index.cfm?uuid=099D90D3D0B759A1E32BC9906EE13A96">low-density lipoprotein (LDL) apheresis machine</a></strong>.<span id="more-390"></span></p>
<p>Think of it as a device that scrubs the blood clean, much like kidney dialysis, except that the machine targets and removes bad <strong>LDL <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a></strong> instead of the impurities removed by dialysis.</p>
<p>The <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a> machine draws the patient’s blood from one arm. It then breaks the blood down into red blood cells and plasma, sending the red cells back into the patient’s bloodstream. Meanwhile, the machine infuses the blood plasma with the blood thinning drug <strong><a href="http://www.heparin-legal.com/tag/heparin/" title="" rel="external">heparin</a></strong>, which binds to the <strong>LDL <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a></strong>, thereby drawing it out of the plasma. The device then sends the clean plasma back into the patient&#8217;s other arm.</p>
<p>The machine removes and cleans 2.5 liters of blood, about half of the body’s blood supply.</p>
<p>This two-hour process is short lived, so it must be repeated every two weeks for effective treatment of high <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a>. The therapy is also extremely expensive, costing about $3,000 for each session ($6,000 per month), and as such is currently used only as a last resort for patients who have been unable to lower their <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a> after six months of diet, exercise, and pharmaceutical medicines.</p>
<p>Some people rack up their <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a> score from the foods they eat. For others, too much bad <strong>LDL <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a></strong> is produced by the liver, thanks to the family genes. For many, elevated <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a> comes from both sources.</p>
<p>To combat the <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a> problem on both fronts, <strong><a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a></strong> teamed up with <strong><a href="http://www.vytorin-lawyer.com/tag/schering-plough/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Schering-Plough">Schering-Plough</a></strong> to create <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a></strong>, a drug that combines <a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a>’s <strong>Zocor</strong> with <a href="http://www.vytorin-lawyer.com/tag/schering-plough/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Schering-Plough">Schering-Plough</a>’s <strong><a href="http://www.vytorin-lawyer.com/tag/zetia/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Zetia">Zetia</a></strong>. However, clinical trials revealed that the drug was at best a flop and at most a toxic cancer-promoting drug. In either case, it <strong>failed to treat <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a> any more effectively than cheaper generic statins</strong>.</p>

<p>These newest job cuts come on top of cutbacks that <strong><a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a></strong> made as part of an earlier restructuring program. <strong><a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a></strong> began eliminating 10,400 jobs from its global workforce in 2005 and completed that set of cutbacks last month.</p>
<p><strong><a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a>’s</strong> Chief Executive, Richard Clark, acknowledged the company faced a challenging economic environment in the immediate future.</p>
<p>&#8220;Our current sales trends for key products, compounded by known industry and emerging economic factors, have led us to reassess the environment in which we expect to be operating between now and 2010,&#8221; he said in a <a href="http://www.merck.com/newsroom/press_releases/financial/2008_1022.html">statement</a>.</p>
<p>According to <a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a>, the 12-percent reduction of its workforce translates to 6,800 employees losing their jobs and some 400 vacancies that will go unfilled. The measures should amount to a savings of $3.8 billion to $4.2 billion by the end of 2013, the company said.</p>

Studies have indicated that <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a></strong> is no more effective than cheap generics and that using it may increase the risk of developing cancer and dying from cancer.</p>
<p>Negative press has knocked <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a></strong> and its component <strong><a href="http://www.vytorin-lawyer.com/tag/zetia/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Zetia">Zetia</a></strong>, which is also prescribed separately, down from blockbuster status to something more of a financial and legal liability.</p>

Not so, however. <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a></strong> refuses to assume its place on the list of has-beens with grace. Instead, it continues to stumble, choke, and flail.</p>
<p>The latest monthly data for <strong><a href="http://www.vytorin-lawyer.com/tag/schering-plough/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Schering-Plough">Schering-Plough</a></strong> shows that <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a></strong> prescriptions continue to decline. Prescriptions for <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a></strong> were down 3.7 percent in September, and the drug’s share of the <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a> market dropped from 6.4% to 6% in August. Before the SEAS and Enhance trials, <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a></strong> took about 8 percent of the total <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a> market.</p>
<p>At the same time, prescriptions for <strong><a href="http://www.vytorin-lawyer.com/tag/zetia/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Zetia">Zetia</a></strong>, <strong><a href="http://www.vytorin-lawyer.com/tag/schering-plough/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Schering-Plough">Schering-Plough</a>’s</strong> half of the dualistic <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a></strong>, dropped 1.5% in September. <strong><a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a>’s</strong> <strong>Zocor </strong>comprises the other part of <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a></strong>. Together, <strong><a href="http://www.vytorin-lawyer.com/tag/schering-plough/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Schering-Plough">Schering-Plough</a></strong> and <strong><a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a></strong> shared 15.2% of the <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a> management market last January. By June their share had fallen to 12.1 percent. Last month, the share dropped further to 10.8 percent.</p>
<p>Since <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a></strong> failed to meet it primary endpoint in the SEAS trial, was shown to be no more effective than cheaper generic statins, and has been linked to increased cancer risks, it makes you wonder why it’s being prescribed at all.</p>

			<content:encoded><![CDATA[<p>Following <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" title="" rel="external">Vytorin</a>’s </strong>recent fall from its blockbuster status, <strong><a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a></strong> is ratcheting up studies of its new <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a> fighting drug, <a href="http://washingtontimes.com/news/2008/oct/17/merck-expands-cholesterol-study-for-faster-resu-1/"><em>The Washington Times</em> reported</a>.</p>
<p>MK-0524A, as the new drug is called, is the subject of a study based in Oxford University in England. <a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a> submitted the drug to the <strong>FDA</strong> for approval, but it was rejected last April. The <strong>FDA</strong> wanted results from the study known as THRIVE (Treatment of HDL to Reduce the Incidence of Vascular Events) before it made another ruling.<span id="more-351"></span></p>
<p>The study already involves 20,000 people from the UK, Scandinavia, and China who are taking the experimental drug. The problem for <a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a>, however, is the timeline. The study began in 2006 and is set to end in January of 2013. Sufficient data wouldn’t be available until 2010.</p>
<p>To speed the study along, <strong><a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a></strong> will increase the number of participants in THRIVE to 25,000. <strong><a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a></strong> hopes that having more trial participants will amount to obtaining results several months earlier.</p>
<p>In a <a href="http://www.pharmalot.com/wp-content/uploads/2008/10/thrive-press-release-1710081.doc">statement </a>issued by Oxford University, Professor Jane Armitage, one of the principal investigators of MK-0524A sounded hopeful about the study’s expansion, saying that “In terms of numbers, bigger is very much better.”</p>
<p>“This enhancement will give us a more powerful tool with which to assess this intervention for the benefit of heart patients everywhere. The study is scheduled to end in 2013, but with these additional patients, we hope that it will be able to report sooner,” she said.</p>

Researcher claim that by speeding up the THRIVE trial, they will be able to help people with vascular disease sooner. For <strong><a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a></strong>, it’s likely to be a matter of replacing lost profits and establishing a pipeline that’s more appetizing to investors.</p>

The question seems like it would be simple to answer, yet finding the answer requires navigating through a murky labyrinth of botched test results, apparent cover-ups, possible payoffs, and a whorl of conflicting interpretations that sometimes resemble self-interest, sometimes truth, depending on whom you ask.<span id="more-341"></span></p>
<p>The University of Washington’s Thomas Fleming is one respected statistician and adviser to the <strong>FDA</strong> who cautions against dismissing <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a>’s </strong>link to cancer as merely an anomaly. Leading researchers involved with the <strong>SEAS </strong>study, which uncovered a <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a></strong>-cancer link, maintain that the results were a fluke.</p>
<p>In an <a href="http://content.nejm.org/cgi/content/full/NEJMe0807372">editorial</a> published in <em>The New England Journal of Medicine</em>, Fleming says that at this point in time, it’s too early to dismiss the <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a></strong>-cancer link. He suggests that the drug may have more <strong>adverse side effects</strong> than actual benefits. “ … There are numerous recent cases in which it has been established or strongly suggested that [side] effects of such [drugs] have adversely altered their risk–benefit profile.&#8221;</p>
<p>Scientists quick to dismiss <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a>’s </strong>apparent link to cancer support their case by pointing to two larger ongoing studies that appear to diminish the drug’s risks. According to Fleming, however, &#8220;There are clinically important increases in the risk of cancer-related death that are not ruled out by this data.&#8221; He also argues that prematurely releasing results from the other tests jeopardizes their conclusions.</p>
<p><strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a></strong> sales soared to the tune of $5 billion in 2007, but dropped by a third after reports of negative tests began to surface. Prescriptions plummeted and along with them, company revenues. Government inquiries about the release and apparent manipulation of clinical data are amounting to a public relations debacle.</p>
<p>Today, <strong><a href="http://www.vytorin-lawyer.com/tag/schering-plough/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Schering-Plough">Schering-Plough</a></strong> announced that it will eliminate 1,000 positions from its 5,000-rep sales force. The cutbacks are part of a 10 percent reduction of <strong><a href="http://www.vytorin-lawyer.com/tag/schering-plough/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Schering-Plough">Schering-Plough</a>’s</strong> general workforce, which the company announced last April. Altogether, the cuts represent $1.5 billion in savings. <strong><a href="http://www.vytorin-lawyer.com/tag/schering-plough/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Schering-Plough">Schering-Plough</a>’s</strong> purchase of Organon Biosciences for $14.4 billion is another key factor in its decision to cut back and reorganize its workforce. Interestingly, in a statement to the Associated Press, <strong><a href="http://www.vytorin-lawyer.com/tag/schering-plough/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Schering-Plough">Schering-Plough</a></strong> says the cuts are designed to improve the company’s customer relations.</p>
<p><strong><a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a></strong> announced back in May that it was cutting 1,200 sales reps from its work force, on top of already 8,100 additional positions slashed in 2005. <strong>Ken Frazier</strong>, president of <strong><a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a>’s</strong> global human health unit, issued the following statement regarding the cuts:</p>
<p>“With eight successful launches of <strong><a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a></strong> products approved in the US since 2006 now behind us, and with an unexpected delay in a new product approval, we decided to accelerate the achievement of efficiencies we anticipate gaining as we transition to our new commercial model in the US.”</p>

The <strong>SEAS</strong> study roused concern back in July when researchers revealed a possible link between cancer and the <strong><a href="http://www.vytorin-lawyer.com/tag/zetia/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Zetia">Zetia</a></strong> half of <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" title="" rel="external">Vytorin</a></strong>. <span id="more-271"></span></p>

To support their claim, they point to two larger studies still in progress – <strong>SHARP</strong> and <strong>IMPROVE-IT</strong>. Numbers from those studies combined still show a higher rate of cancer among <strong><a href="http://www.vytorin-lawyer.com/tag/zetia/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Zetia">Zetia</a></strong> users, but only enough to be statistically irrelevant or at least inconclusive.</p>
<p>However, some professionals who are following the study, including a panel of doctors from <em>The New England Journal of Medicine</em>, argue that there is indeed a legitimate cause for concern, not the least of which that all three trials revealed more cancer in <strong><a href="http://www.vytorin-lawyer.com/tag/zetia/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Zetia">Zetia</a></strong> users. They also point out that <strong><a href="http://www.vytorin-lawyer.com/tag/zetia/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Zetia">Zetia</a></strong> “interferes with the gastrointestinal absorption not only of <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a> but also of other molecular entities that could conceivably affect the growth of cancer cells.”</p>
<p>The other “molecular entities” include the tumor-fighting and <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a>-busting superhero: plant-derived <strong>sterols</strong>. People ingest sterols every time they eat fruits and vegetables. Because <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a></strong> interferes with the body’s absorption of sterols, then it may, in theory, promote cancer.</p>
<p>The <strong>FDA</strong> expects to receive a final <strong>SEAS</strong> report in about 12 weeks. The agency anticipates it will take another 6 months to review and evaluate the study data, after which it will issue its conclusions and recommendations. In the meantime, the <strong>FDA</strong> has advised health care professionals to monitor their patients on <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a></strong> and to report side effects to the agency.</p>

From April 2006 to mid-January of 2008, <strong><a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a></strong> and <strong><a href="http://www.vytorin-lawyer.com/tag/schering-plough/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Schering-Plough">Schering-Plough</a></strong> withheld the ENHANCE trial results while they continued to aggressively advertise <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a></strong>.<span id="more-375"></span></p>
<p><strong>Suffolk County</strong> joins Congress and a growing number of individuals and municipalities in claiming it had been ripped off by the pharmaceutical giants. <strong>Suffolk County’s</strong> case states that <strong><a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a></strong> and <strong><a href="http://www.vytorin-lawyer.com/tag/schering-plough/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Schering-Plough">Schering-Plough</a></strong> engaged in a “scheme … calculated to ensure that Plaintiff would pay for <strong><a href="http://www.vytorin-lawyer.com/tag/zetia/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Zetia">Zetia</a></strong> and <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a></strong> despite cheaper and effective alternatives.</p>
<p>However, <strong>Suffolk County</strong> has added a little more heft to its lawsuit than other similar suits filed against the drug companies. On page 25 of the deposition, <strong>Suffolk County</strong> claims:</p>
<p>“Defendants have conducted and participated in the affairs of the Enterprise through a pattern of racketeering activity that includes <strong>acts indictable</strong> under 18 U.S.C. ++ 1341 and 1342 (mail and wire fraud) …”</p>
<p>Confusion and outrage have surrounded the ENHANCE trial results and the way in which <strong><a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a></strong> and <strong><a href="http://www.vytorin-lawyer.com/tag/schering-plough/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Schering-Plough">Schering-Plough</a></strong> officials released the results, sparking Congress to launch an investigation. The Suffolk <strong>County</strong> lawsuit, however, goes further than just accusing the companies of negligence; it claims the companies may have acted criminally. In this lawsuit we see phrases indicating some serious charges:</p>
<p>“…<strong>concealing</strong> from Plaintiff and physicians, and the public the results of the ENHANCE study …”</p>

What about <strong><a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a>’s </strong>maxim “Where patients come first?” Does it evoke feelings of warmth and trust or does it just induce rolling eyeballs?<span id="more-290"></span></p>
<p>To be completely fair, pharmaceutical companies continually develop vaccines and medicines that improve the quality of life for millions of people throughout the world. Many modern pharmaceuticals also extend and save lives. In the western world, we can’t imagine life without these modern medicines.</p>
<p>However, events surrounding the drug <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" title="" rel="external">Vytorin</a> </strong>have cast into doubt the intentions – and the integrity &#8211; of pharmaceutical giants <strong><a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a></strong> and <strong><a href="http://www.vytorin-lawyer.com/tag/schering-plough/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Schering-Plough">Schering-Plough</a></strong>. As marketing expert Rob Frankel recently told <em>Advertising Age</em> magazine, “The pharmas are in big trouble in terms of credibility. They’re just above congress and used-car salesmen.”</p>
<p>Why?</p>
<p>First there is the ENHANCE study that revealed the pairing of <strong><a href="http://www.vytorin-lawyer.com/tag/zetia/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Zetia">Zetia</a></strong> and <strong>Zocor</strong> to be no more effective than <strong>Zocor</strong> alone in treating arterial plaque. But more than the disappointing results, there was the delay in making this information public. Results of the ENHANCE trial were completed in April 2006 but were not released until January 2008, after mounting pressure and suspicion over the delay.</p>
<p>On May 1, 2007, before the ENHANCE results were made public, <strong><a href="http://www.vytorin-lawyer.com/tag/schering-plough/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Schering-Plough">Schering-Plough</a>’s</strong> president <strong>Carrie Smith Cox</strong>, dumped 900,000 shares of company stock, worth an estimated $28 million. The sale prompted Congress to investigate the upper realms of <a href="http://www.vytorin-lawyer.com/tag/schering-plough/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Schering-Plough">Schering-Plough</a> for concrete evidence of insider trading.</p>
<p>While ENHANCE data were being withheld, <strong><a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a></strong> and <strong><a href="http://www.vytorin-lawyer.com/tag/schering-plough/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Schering-Plough">Schering-Plough</a></strong> continued to heavily advertise <a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a>, spending hundreds of millions on the famous commercials featuring the aunt who looks like a pot roast. The companies knew the results of the study, yet their aggressive marketing raked in $3-5 billion per year since <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a>’s</strong> appearance on the market. Meanwhile, patients continually overpaid for a drug that didn’t do what the ads claimed it would do.</p>
<p>Congress again stepped in to demand answers as to why consumers, including the federal government, had been fleeced for so long. Senator <strong>Chuck Grassley</strong> of Iowa sent a <a href="http://www.senate.gov/~finance/press/Gpress/2008/prg033108.pdf">letter</a> to the top of both companies in which he stated, “I have an obligation to the more than 80 million Americans who receive health care coverage under Medicare and Medicaid to ensure that taxpayer and beneficiary dollars are spent in a fiscally sound manner.” In the same letter, he also pointed out that at, “… a Wal-Mart pharmacy in Iowa City, generic simvastatin costs $54.54 for a month&#8217;s supply. On the other hand, <a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a> costs $112.46&#8211;more than twice as much.”</p>
<p>The federal government is also investigating why the ENHANCE test results released by <strong><a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a></strong> and <strong><a href="http://www.vytorin-lawyer.com/tag/schering-plough/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Schering-Plough">Schering-Plough</a></strong> differ from the information released by those who conducted the study. A <a href="http://energycommerce.house.gov/Press_110/110-ltr.121107.ScheringMerck.ltr.pdf">letter</a> from the U.S. House of Representatives Committee on Energy and Commerce to Fred Hassan (<strong><a href="http://www.vytorin-lawyer.com/tag/schering-plough/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Schering-Plough">Schering-Plough</a></strong>) and Richard T. Clark (<strong><a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a></strong>) states, “The ENHANCE trial was completed in 2006, and yet no data from the trial have been published or presented in their entirety. In fact, it appears that the study itself was not registered with <strong>ClinicalTrials.gov</strong> until October 31, 2007, a full 18 months after completion of the study. In addition, the endpoint indicated in the <strong>ClinicalTrials.gov</strong> web site appears to differ from the endpoint described in the initial study design.”</p>
<p>Representative <strong>Bart Stupak</strong> , D-Mich, told CBS’s Early Show “There’s certainly major misrepresentations not only to the effectiveness of the drug, but manipulating of the scientific data to further promote a product that isn’t doing what it was designed to do.”</p>
<p>With all of the controversy surrounding <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a></strong>, it would seem that <strong><a href="http://www.vytorin-lawyer.com/tag/schering-plough/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Schering-Plough">Schering-Plough</a></strong> has sought to earn more mistrust every day and that <a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a> intentionally put profits before people.</p>

<p><strong><a href="http://www.vytorin-lawyer.com/tag/merck/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Merck">Merck</a></strong> and S<strong>chering-Plough</strong> teamed up to create <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a></strong>, a new <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a>-fighting drug that combined the power of statins with <strong><a href="http://www.vytorin-lawyer.com/tag/zetia/" class="st_tag internal_tag" rel="tag" title="Posts tagged with Zetia">Zetia</a></strong>, a drug that reduces absorption of <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a> in the intestine. In this way, the battle against <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a> would occur on both genetic and dietary fronts.</p>
<p>Data from the <strong>ENHANCE</strong> study, however, revealed that <strong><a href="http://www.vytorin-lawyer.com/tag/vytorin/" class="st_tag internal_tag" rel="tag" title="Posts tagged with vytorin">Vytorin</a></strong> was largely a flop. While it lowered LDL <a href="http://www.vytorin-lawyer.com/tag/cholesterol/" class="st_tag internal_tag" rel="tag" title="Posts tagged with cholesterol">cholesterol</a>, it did nothing to actually reduce plaque in the carotid arteries as promised.</p>
<p>Dr. Harlan Krumholz, a Yale University cardiologist, told the Associated Press that “people need to turn back to <strong>statins</strong>. We know that statins are good drugs. We know they reduce risks.”</p>
